V Tre is an art archive platform operated by V Tre cc, Inc., a Delaware corporation ("V Tre", "we", "us"). The platform provides a searchable archive of contemporary and rare art exhibitions, an AI-assisted submission pipeline for galleries and artists, and analytics tools for archive contributors. These Terms of Use ("Terms") govern your access to and use of vtre.cc and any related services.
By accessing or using V Tre, you agree to these Terms. If you do not agree, do not use the platform.
You may use V Tre if you are at least 18 years old and are not prohibited from using the platform under applicable law. By creating an account, you represent that all information you provide is accurate and that you will keep it current.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you become aware of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
When you submit exhibition materials, press releases, images, checklists, or other content to V Tre ("Submitted Content"), you grant V Tre a worldwide, non-exclusive, royalty-free licence to store, display, process, and index that content for the purposes of operating and improving the archive. This licence continues for the duration of your relationship with V Tre and for two years following termination, after which we will delete your Submitted Content on request.
You represent and warrant that: (a) you own or have the necessary rights to all Submitted Content; (b) your Submitted Content does not infringe any third-party intellectual property rights; and (c) your Submitted Content is accurate to the best of your knowledge.
We reserve the right to reject, remove, or decline to publish any Submitted Content at our editorial discretion.
Submitted Content may be processed by AI tools, including the Anthropic Claude API, to extract structured metadata such as artist names, work titles, dimensions, media, and prices. This processing is carried out on your behalf to facilitate archive creation. We do not use your Submitted Content to train AI models. Anthropic processes data under a data processing agreement and does not retain submitted materials.
The V Tre platform, including its software, design, archive structure, and editorial curation, is owned by V Tre cc, Inc. and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our prior written permission. Individual artworks and exhibition materials remain the property of their respective rights holders.
V Tre strives to maintain an accurate archive but does not guarantee the completeness, accuracy, or currency of any listing, price, or attribution. The archive is provided for informational and reference purposes. V Tre is not responsible for errors introduced through AI extraction or submitted by contributors.
If you are a contributor with access to analytics dashboards, the data displayed reflects aggregated, anonymised engagement with your archive pages. You may use this data for your own business purposes. You may not resell, redistribute, or commercially exploit analytics data derived from V Tre without our written consent.
Where V Tre facilitates transactions between sellers and buyers of artworks or rare books ("Marketplace"), V Tre acts solely as an intermediary. V Tre is not a party to any transaction between sellers and buyers. We are not responsible for the condition, authenticity, legality, or delivery of any item listed on the Marketplace. All Marketplace transactions are subject to any additional terms presented at the time of purchase.
Service fees apply to Marketplace transactions as disclosed at the time of listing. Fees are non-refundable except as required by law.
You agree not to: (a) submit false, misleading, or fraudulent content; (b) use the platform to infringe the intellectual property rights of any third party; (c) scrape, harvest, or systematically extract data from the platform without our written consent; (d) attempt to gain unauthorised access to any part of the platform or its infrastructure; (e) use the platform for any unlawful purpose or in violation of any applicable law or regulation; or (f) interfere with the operation or integrity of the platform.
The platform may contain links to third-party websites or services. V Tre is not responsible for the content, privacy practices, or terms of any third-party site. Links do not constitute endorsement.
The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, V Tre cc, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms or your use of the platform will not exceed the amount you paid to V Tre in the twelve months preceding the claim, or €100, whichever is greater.
You agree to indemnify and hold harmless V Tre cc, Inc. and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the platform, your Submitted Content, or your violation of these Terms.
We may suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. You may close your account at any time by contacting us at [email protected]. Termination does not affect any rights or obligations accrued prior to termination.
We may update these Terms from time to time. We will notify registered users of material changes by email or by posting a notice on the platform. Continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of these Terms or your use of the platform will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
